St. Paul Harley Dealer Wins Ruling On New Sales Rules

Source: The Business Journal by Jim Hammerand, Minneapolis / St. Paul Business Journal

A federal judge has put the brakes on new Harley-Davidson sales restrictions that a St. Paul dealership said would put it out of business.
U.S. District Judge Patrick Schiltz on Monday ordered Milwaukee-based Harley-Davidson Motor Co. not to enforce its ban on sales of parts, accessories and apparel through third-party websites or to international customers. The judge's order is effective through Feb. 29.
St. Paul Harley-Davidson (incorporated as St. Paul Motorsports Inc.) sued the motorcycle manufacturer in October to fight the policies, which would eliminate about a quarter of the 72-year-old dealership's revenue.

Updates And Lower Price For Street Performance Tuner

Factory Engine Calibration Uploads Available Directly to Owners

Harley-Davidson owners can now use the Screamin’ Eagle Street Performance Tuner (P/N 41000008B, $249.95) to upload and install the latest factory ECM (electronic control module) calibrations to match specific hardware upgrades, including high-flow air cleaners, Street Performance mufflers, and Big Bore engine kits. Previously, an authorized Harley-Davidson dealer was required to complete these software uploads. The revised Street Performance Tuner also gives the owner the ability to view and clear ECM trouble codes, and to collect real-time vehicle data, which can then be displayed on a computer screen. Finally, Harley-Davidson has lowered the suggested retail price of the Street Performance Tuner to $249.95.

With the Street Performance Tuner, the Harley-Davidson owner can install factory-calibrated ECM software that will deliver the best all-around performance for a specific model and its state of tune after EPA-compliant performance modifications are made to EFI-equipped Harley-Davidson models. The kit also includes the Vehicle Communications Interface (VCI) module that records up to 15 minutes of run-time data on up to 27 variables that can be downloaded to a PC. Using the included software, the motorcycle owner or a technician can evaluate engine operating parameters such as the air/fuel ratio, O2 sensor readings, engine speed and temperature, RPM and vehicle speed, throttle position, spark advance, and many more performance characteristics of the motorcycle. The VCI will also record and display service codes for troubleshooting and diagnostics.

The Screamin’ Eagle Street Performance Tuner may be installed on 2007-later Sportster and XR, Dyna, Softail and Touring models (except Trike).

Toy Run Is Hobbled After Court Ruling In Dispute Between Mayor, Police Chief

by Paul Carpenter — The Morning Call
After 27 consecutive years without a hitch, somebody threw a monkey wrench into an annual event that provides thousands of toys to disadvantaged children each holiday season — just six days after the event's organizer won the latest court victory in a long and bitter dispute with the local police establishment.

On Nov. 14, a ruling by Lehigh County Judge Michele Varricchio reaffirmed previous rulings that Macungie Mayor Rick Hoffman is in charge of the borough police department, as the law clearly provides, and Police Chief Edward Harry Jr. cannot deny Hoffman access to the department.
Last Sunday, the motorcycle organization ABATE held its 28th annual Lehigh Valley Toy Run, with a procession of 1,500 motorcycles and other vehicles carrying toys from the Walmart store in Lower Macungie Township to the Volunteers of America Children's Center in Allentown.
On all 27 previous toy runs, police and other authorities provided escorts and helped the long processions stay together by moving through intersections without interference from traffic lights or other obstructions.

Harley-Davidson's CEO Is Trying To Save His Company By Copying Ford

From www.businessinsider.com
Harley-Davidson has been in trouble over the past five years. Bike sales have plummeted 31% since 2006, its core customer base is aging rapidly and the market downturn has quashed people's demand for $20,000 motorcycles.
But lately, there have been glimmers of hope. Harley is about the have its first annual sales gain in nearly half-a-decade, and its stock has more than doubled since CEO Keith Wandell took the helm two years ago.

Riding Motorcycles in the Gambia

The following story was submitted by David Beardsley, Siofe Village, The Gambia in Africa. David had sent me three YouTube videos for my YouTube Motorcycle Videos feature. He then offered to write an article about his life with motorcycles in this far off place to most of us. Here's his story:
"I decided it was the ideal time to have a mid-life crisis and search for my long-forgotten childhood, so about four years ago I decided that I should do something about it. Having given it much thought and being a practical sort of guy, I decided that a new motorcycle was in order -- decision made. “Easy” I hear you say - but there was a slight problem. I live in The Gambia, West Africa, and new motorcycles are rarer than chickens’ teeth and anything required has to be imported and manufacturers’ warranty is not something mentioned here. The only dealer importing motorcycles brings in SYM from China - designed for anyone vertically challenged as the seat height is lower than the ground clearance on most children’s bikes and the acceleration is something akin to paint drying on a damp day.

The Internet is a wonderful medium for finding information - and more importantly - specifications so I spent time comparing specs and reading of other bikers’ views. I must point out that I am not exactly new at riding having started in my teens when BSA, Royal Enfield and Triumph ruled the roads and Japanese bikes were few and very far between.

My first motorcycle was a Francis Barnet, a whole 125cc, not quite as fast as a striking slug, but it did get me to and from work, etc. During the ensuing years, I rode an assortment of machines and, whilst a member of HM Forces, spent many happy years on a BSA B40. Along with some of my colleagues, I became quite involved in the Trials scene and this led to organizing events that were open to civilian riders. I rode the Welsh Two-Day several times on an Army B40 and have the medals to prove it! Anyone who has ridden one will tell you it is not the ideal cross-country machine as the suspension travel is only a few inches and it needs either a very skilled rider to negotiate the terrain or someone with considerable strength to pull it out of the Welsh Bogs, of which there were many. I fell into the second class of rider but what has that got to do with The Gambia and buying a new bike I hear you ask? Absolutely nothing but it was nice to reminisce.

Having hit the web, I decided on a Honda from Motosport of Tampa but, being a little on the chunky side, decided that I needed a reasonable amount of horsepower to move that bulk without strain. The chosen bike was the Honda XR650L, air-cooled, designed to withstand rough terrain but also built to an exceptionally high standard of engineering - what did we do wrong all those years ago that lost Britain the motorcycle industry? These were not being imported into the UK so went “States-side” to find what I wanted. I might just add that the dollar was at two to the Pound Sterling at this time so I got a terrific deal. I was also in the fortunate situation that someone was bringing a container from the USA and had some spare space - just ideal for the Honda that was still in its protective cladding from the factory.

The USA has some strange rules; one of them being the machine had to be removed from said cladding, built up, tested to make sure it was ok and then dismantled and repacked. This done, the bike was sent to the shippers and I sat and waited for my boat to come in. Eventually it arrived and was delivered to our house. For those who are interested, we live in the middle of the Bush near a village called Sifoe (visit: www.reducetheuse.org.uk) and just getting things delivered can be a trauma. Fortunately, a friend of ours, Paul, (an American missionary and working here) was also buying a bike, a Kawasaki, from the same supplier so the deal was he would deliver them to our house and I would put them together.

Have you ever seen two boys drooling whilst looking in the sweet shop window? Well that was us! It’s amazing how fast we managed to unpack the boxes just so that we could see what was inside.

As Paul lives quite a distance from us, his was first to be assembled so that he could get home before dark - roads are not good here because of the absence of street lighting and also there are the hazards of drivers who do not turn on the lights in case they might wear out the bulbs! There were absolutely no problems putting them together and we even put Airseal in the tyres to reduce the likelihood of punctures from the debris that litters the roads and tracks here.

The Honda went together very easily and looked stunning. Getting on it is quite easy if you have a step ladder or are 7-feet tall as the ground clearance is an impressive 13 inches, making the saddle height a daunting 31 inches from Terra Firma. This gives a whole new meaning to getting your leg over! This is a tall bike but it handles magnificently and corners superbly despite what you may think.

The engine was carefully run in. As an ex mechanical engineer, I still believe that easy treatment during the first couple of hundred miles pays dividends at a later date. Time will tell! During this time, it was noticeable that the engine was definitely not delivering the power of which it was capable because of the smog prevention kit and spark arrestor that are fitted to comply with Californian legislation.

Baja Designs are whiz kids with the XRs and a quick email resulted in a Smog Block Off kit and the replacement Dynojet goodies. These arrived at about the time that the running-in was completed and I got to work on removing the air pump, smog canister and rubber piping that was surplus to requirement. I must praise Baja for their superb after sales service and the helpful, knowledgeable staff they employ. Carburettor duly modified, I gave the bike a road test; the response was amazing - and I still had to do the exhaust. The Gambia does not, as yet, have noise or emission controls so there was no problem in taking out the spark arrestor from the exhaust - it now sounds superb and has even more power. Ultimately I purchased a Big Gun exhaust that sounds fantastic and improved the response even more.

The road conditions here are ok but tarmac is only laid on the main roads so it really is an off-road paradise but care has to be taken as goats, donkeys and monkeys tend not to observe the Highway Code. Children are not taught even the basics of road safety so great care is needed at all times. The surface can change from tarmac to compacted earth to loose sand faster than a speeding bullet so tyre choice is very important. The bike was fitted with Bridgestone TWs, good on the road, not bad on the hard pack but awful on loose sand and, as I needed something that would be suitable for all surfaces, I hit the web again.

Life is full of surprises and, whilst searching, came across Trellesport Tyres in The UK. They were advertising a tyre designed for the Swedish Army that met all my criteria so I telephoned them. I last saw Gwyn Barraclough in the early ‘80s when we both competed in Army Motorcycling at National and International level. Gwyn competed in the ISDE on numerous occasions - but then he was good. When I spoke to the person at the other end of the telephone, I had no idea who it was but, when I gave my name, he asked, “Are you by any chance Dave Beardsley?” They do say it’s a small world; suffice to say, I now buy all my tyres and heavy duty tubes from him or Janet (when Gwyn is away instructing riders at a well respected off road experience centre) - and always get excellent service. The tyres are the best I have used and are great in all conditions. Wear rate is also acceptable but could be improved if the throttle was used more gently.

The bike is now well and truly run in, having done 36,000 miles since delivery, hasn’t missed a beat and goes wonderfully well. The oil and filters are changed every 2500 miles and I only use Castrol oil as it is a known brand – lots of poor quality stuff is imported into Africa so it is a case of buyer beware. Fuel consumption is not brilliant, about a hundred miles to a 2.77 gallon tank (that’s the smaller American Gallons - and they say everything is bigger in America) but consumption would be much better if the throttle wasn’t kept in the fully open position by a rider searching for his childhood.

Powersports University Gives The Gift That Keeps On Giving

Education Is A Process, Not A One-Time Event
IRVINE, CA, November 8, 2011: Just in time for the Holiday Selling Season, Powersports University has initiated a special incentive program to help dealership personnel earn while they learn. PSU’s online courses were created to help employees become better and more competitive in the areas of aftermarket exhausts, wheels, controls, seats, custom accessories and more. Just think of PSU training as the gift that keeps on giving all year round.

PSU believes that education is an ongoing process rather than a one-time event, so they are rewarding dealership personnel for their ongoing learning efforts. Gifts for PSU grads include a free iPad (pre-loaded with Cycle News digital edition), shocks from Progressive Suspension, chain and sprocket kits from Renthal and other prizes. This is above and beyond the certificates of completion and the other bonuses already awarded to successful graduates.
The rules are pretty simple… Dealership personnel just need to pass any complete PSU course between November 1-December 31, 2011, and they will be eligible to win random swag. Training courses already up and running include Küryakyn, Mustang Seats, Performance Machine, Progressive Suspension, Renthal and Vance & Hines.
“We wanted to expand our commitment to dealer education, so what better time than the holiday selling season,” asks Brian Etter, President & CEO of Motorsport Aftermarket Group. “Better trained, more knowledgeable dealership personnel will ensure our customers will have happy holidays!”
Get the gift that keeps on giving by logging onto www.PowerSportsU.com and enrolling in classes that you haven’t passed yet!

City of Sturgis Reduces Vendor List Fee From $600 to $20

Source: Rapid City Journal
Sturgis has dropped its asking price for a copy of the list of vendors at the annual Sturgis motorcycle rally to $20. The city had originally been asking $600 for a copy of the list.
Previous city manager, David Boone, raised the asking price from $50 to $600 when he began the job. City finance officer Fay Bueno said the amount of labor that is put into compiling the list of more than 700 vendors is what drove the cost up.
The price of the document has remained a hot topic for those requesting the list, including Sturgis resident Jack Hoel, who sent a letter to Attorney General Marty Jackley concerning the subject.

"This is obviously a public record," Hoel said.
The letter sent back to Hoel states that "public documents must be provided upon ‘payment of the actual cost of mailing or transmittal, the cost of reproduction, or other fee established by statute or administrative rule.'" The letter goes on to say that under state statute, requests for public records that involve more than an hour of staff time to locate, assemble or reproduce may be billed extra.

Harley-Davidson Leads Next Generation of Consumer-Led Marketing

Innovative Crowdsharing Approach, Fan Machine, Engages Company Faithful on Facebook

By Harley-Davidson Motor Company
Published: Monday, Nov. 7, 2011 - 1:12 pm
MILWAUKEE, Nov. 7, 2011 -- /PRNewswire/ -- Today Harley-Davidson Motor Company shifts its commitment to crowdsourcing into a higher gear by launching a new Facebook application that sources advertising ideas directly from Harley-Davidson's millions of Facebook fans.

Fan Machine allows Harley-Davidson's Facebook community to review an advertising brief, submit ideas and vote on ideas from other community members. After selecting and rewarding the winners, Harley-Davidson will work with existing marketing partners to bring the best creative ideas to life. Harley-Davidson has crowdsourced ideas like this for a year, but not with the massive scale of Facebook.
Harley-Davidson is in the midst of transforming its business to be customer-led throughout the company, which includes marketing approaches such as the pioneering use of crowdsourcing.
"This is not a publicity stunt, or a limited time engagement. We're committed to crowdsourcing, because these ideas naturally flow from our passionate fans," said Mark-Hans Richer, Harley-Davidson's Chief Marketing Officer. "As the true stewards of our brand, our fans now have a huge new platform to share their ideas.
"It works for us because their passion for our brand is second-to-none. They're going to light this thing up, and it will be fun to watch. Facebook also proves this passion is passing along to the next generation, where 40 percent of our fans are between the ages of 18 and 34."
Harley-Davidson's first foray into crowdsourced marketing resulted in 'No Cages,' the Motor Company's ad campaign that debuted in February.
"Getting a brand's fans and followers involved in co-creating advertising ideas is the future of marketing," said John Winsor, CEO of Victors & Spoils, the agency that produced 'No Cages.' "We're excited to work with Harley-Davidson as our first brand partner using the Fan Machine technology, a logical choice because of our deep partnership and their passionate fans."
The first Fan Machine brief, which will focus on building on the 'No Cages' campaign, is available on the Harley-Davidson Facebook page -- www.facebook.com/harley-davidson.

Wire Plus Introduces New Big Dog “HCM” Retrofit Kit

Wire Plus Powersports Electronics is proud to introduce their new, state-of-the-art “HCM” Retrofit Kit for all EHC module equipped 2004-2008 Big Dog Motorcycles. This replacement module is the fix to get rid of the EHC for good. This is the perfect fix for all Big Dog owners tired of not being able to start their bike due to electrical problems. This replacement module works with all of the switches used on all 2004 models through current Big Dog Motorcycles. Each kit comes complete with Wire Plus’ proven power module and switch control module configured to work with the ground input switches used on the Big Dog Motorcycles.

Wire-Plus products are built to survive the rugged urban environment. Their products feature vibration resistant, solid-state breaker technology (the breakers never have to be replaced) and a replaceable start relay that can be purchased at any auto parts store.
Their power modules are submersible waterproof and very compact in size with harnesses that are engineered to be smaller than any other on the market. The lighting control module controls the operation of the front, rear turn signals, and provides load equalization and auto cancelling.  It also operates the rear turn signals as brake lights and running lights with one wire hook-up. Wire Plus’ main focus is on the reliability of everything that they manufacture.
Don Bromlow, National Sales Manager for Wire Plus stated, “We have added ring terminals; butt splices, and wire to the kits to make the hook-up of the ground wires easier. We have also added wire and butt splices for the wires that have more than one wire going to a pin. Combining more than one wire in a pin could compromise the weatherproof qualities of the DEUTSCH connectors. We recommend using a DEUTSCH crimper when making the connections and have these available as well."

Michigan House OKs Partial Motorcycle Helmet Repeal

House bill allows riders 21 and older, who have a motorcycle endorsement for two years, and whom also carry $20,000 in insurance, to ride sans helmet. The Senate bill which passed previously requires $100,000 in insurance. The bill now goes back to Senate to hash out the differences, then on to Governor Snyder for his signature. Two previous repeal bills have been shot down by the former governor Jennifer Granholm. Governor Snyder as been silent about whether he will sign the bill when it reaches his desk. It has been suggested that he would like the bill to be combined with a bill reforming the state's no-fault insurance law.

Lincoln County Massacre Film

A Film by Elaine McMillion
(USA, 2011, 59 minutes)
www.lincolncountymassacre.com

At a time when every motorcyclist was stereotyped as a “Hell’s Angel,” The Brothers of the Wheel club members received a brutal beating by the West Virginia State Police in Lincoln County, West Virginia. The night resulted in the arrest of 15, the hospitalization of four and a federal lawsuit where a jury ruled on behalf of the bikers. Through interviews with club members, eyewitnesses and attorneys, Lincoln County Massacre tells the story of the events leading up to April 20, 1980 and the three years that followed.

The Massacre

On April 19, 1980, the Brothers of the Wheel and The Bootleggers motorcycle clubs met at the White House Tavern, in Lincoln County, W.Va.  They traveled from all over West Virginia, bringing their wives and children, and planned to camp inside the bar that night. But after a larger-than-expected crowd rolled in the town of West Hamlin, the bikers made the decision to camp outside.
To keep warm during the cold April night, men cut down trees for firewood in the woods behind the bar. But the immense darkness blinded their vision causing them to chop down a sapling which fell on a power line. The valley became dark. The loss of power, in addition to the overwhelming amount of “strangers” in the area, caused the neighbors to panic.
Two officers from the Lincoln County detachment of the West Virginia State Police, drove by the bar and noticed an absence of light from within. Troopers B.R. Lester and R.W. Coon pulled over and advised patrons to move to the parking lot and out of the bar, until the power was restored. Both police and bikers say the exchange was civil.
Soon after a local biker wrecked his motorcycle in a neighbor’s freshly seeded yard. A second biker came upon the accident and began to threaten the neighbor, causing locals to panic and call the police. Neither bikers were affiliated with The Brothers of the Wheel or The Bootleggers.
After midnight on April 20,  most of the bikers had cleared the area. The remaining 10 bikes sat outside of the tavern. Some time between 1 a.m. and 2 a.m. state police officers, county sheriffs and officers arrived at the White House Tavern.
What happened from the time the officers arrived and the bikers were taken to jail seems to be a whirl of confusion.
According to the bikers, police arrived on the scene with their headlights off and "snuck" up on them in their sleeping bags and tents. More than 25 police officers jumped out of their cars immediately started beating them with riot clubs, bikers say.
Eyewitnesses and bikers claim that police forced male bikers to lie face-down in broken glass, as they beat them with their “billy sticks.” Women and children were advised to stand against the front of the tavern and watch. The beating continued until there was a pool of blood in the sinkholes of the ground, according to eyewitness Naomi Smith.
Newspaper reports state that officers destroyed the motorcycles, bashing headlights, slashing tires and breaking windows out of cars. Police stated they did not intentionally damage the motorcycles.
15 bikers, including one woman, were taken to Cabell County’s jail.  After being booked, three people were transported to St. Mary’s Hospital in Huntington.
Following the night, bikers filed a federal lawsuit against the state of West Virginia. In 1983, they were awarded a total of $24,000 for damages and hospital bills but were awarded no punitive damages.

Harley-Davidson Honors Active and Retired Military at Home and Abroad for Military Appreciation Month

Press Release:
Company Teams with USO to Provide Care Packages to Soldiers
Harley-Davidson Motor Company will celebrate Military Appreciation Month once again this November with a number of efforts to show its support and gratitude for the men and women in the military. One way the company will do that is by teaming up with the United Service Organizations (USO).

Harley-Davidson will welcome donations at its nearly 650 dealerships throughout the country on behalf of the USO Nov. 1 through Dec. 31. The donations will be used to assemble care packages for troops overseas. The company is also challenging its U.S. Harley Owners Group chapters to raise $500 each for the Operation USO Care Package program.
"We're honored to support such a well-respected organization as part of our military appreciation efforts this year," said Mike McCann, Director of Core Customer and Military Marketing for Harley-Davidson. "We want to show our support for those living away from home and protecting our country."
In addition to supporting the USO through care package donations, Harley-Davidson is celebrating Military Appreciation Month by hosting a military-only concert by the Black Rebel Motorcycle Club in San Diego on Thursday, Dec. 1, where nearly all of the tickets will be given to select soldiers at nearby bases. For one lucky military winner and a guest, Harley-Davidson will provide a full VIP experience for the concert, including travel to San Diego, dinner and a motorcycle ride from Los Angeles to San Diego with the band. Entries for the contest will be accepted online through Nov. 15.
At the Harley-Davidson Museum in Milwaukee, all current and previous military members and their immediate families (one additional adult and up to four children under age 18) will receive free admission on Saturday and Sunday, Nov. 5-6.
Finally, Harley-Davidson's support of the USO will extend through the end of next year. Every care package distributed by the USO in 2012 will include a pair of tickets to the Harley-Davidson Museum – approximately 250,000 tickets in total.
"We're incredibly grateful for Harley-Davidson's support of our efforts to lift the spirits of our brave men and women serving overseas by providing them with care packages that, among other things, offer a touch of home and a way to connect with their families," said USO Sr. VP and Chief Development Officer Kelli Seely. "Like the USO, Harley- Davidson has a long history of supporting U.S. troops, so we are proud of this new partnership and know together we will have a great impact on our troops in the coming year."

Harley-Davidson's history with the U.S. military dates to World War I and World War II.
Today Harley-Davidson supports U.S. military personnel through programs like Harley's Heroes. In 2007, The Harley-Davidson Foundation made its first $1 million grant to Disabled American Veterans to support its Mobile Service Offices that travel throughout the U.S. to provide counseling and assistance to help veterans and their families secure the benefits they earned through their service. The program has become known as Harley's Heroes. Last year, the Foundation made a second $1 million grant to continue its support of the program.
Harley-Davidson also recently sponsored three tours of Bikes Over Baghdad, which brought a team of the biggest names in action sports to bases in Iraq, Kuwait and other parts of the Middle East to perform BMX shows for thousands of troops. For two of the three tours, Harley-Davidson sent one of its own employees along to show the company's personal gratitude.

Shoot the Salt

"Shoot the Salt" is a short documentary that follows Jody Perewitz and Team J’Witz as she attempts to set a land speed record and become the first woman to race an American made motorcycle over 200 mph. Her performance will take place in the stunning Salt Flats of Utah during Bonneville's Bub Motorcycle Trials, on the same grounds where Burt Munro, aka, 'the world's fastest Indian', made history.
Jody’s quest is similar to that of many of daredevils who are driven to test their mettle, and ‘shoot the salt’ for a chance at history. She is fearless, trusts her bike, and has been training hard for the opportunity. But her feat’s distinction lies not only in her gender and machine type, which would be a recorded first, but also in the personal circumstances surrounding the event. Whether she is aware of it or not, Jody is stepping out from the shadow cast by her father, Dave Perewitz, a world-renowned custom bike builder. Not only did her famous Dad build the family name to be synonymous with custom bike building, he also built the machine that will rocket his daughter 200 miles per hour over the earth. A family’s dynamic, an American engine’s strength, and a young women’s belief in herself will all be tested in this uplifting tale about the pursuit of infamy.
